Los Angeles Radio News outlet KFI Reports that the band is suing for "unspecified damages" and that the gun store is "attempting to trick consumers into thinking the website is associated with" GN'R. The suit alleges that the store's operator, a Texas corporation whose name goes by (a bit confusingly) Jersey Village Florist, is doing business without the band's "approval, license, or consent."

However, Texas Guns and Roses does not appear to sell roses or flowers of any kind. KFI says Guns N' Roses attorneys claim the store's name "purportedly sells roses and other flowers as a means of trying to justify" the use of GN'R's trademark.
However, Texas Guns and Roses attorneys have a very different take on the gun shop name. A Houston attorney, representing Jersey Village florist David L. Clark, argues, "There was never any confusion (between the band and the website) and [Guns N' Roses] They have no evidence of confusion."
Clark further adds, apparently without any sense of humor, that the site "sells metal safes for guns and flowersAnd the And you have a one-stop website and no one ever gets 'buzzed' or thinks the store is affiliated with the band, so they'll 'fight back' as a result.

The lawsuit alleges that Guns N' Roses became aware of the store in October of 2019 and sent a cease and desist letter asking the company to change its name, however, Texas Guns and Roses did not comply. GN'R's legal team contends that the nature of this particular business is detrimental to the band, and that they "do not want to be associated with the defendant, who is a firearms and weapons retailer."
It remains to be seen if Texas Guns and Roses will continue this court battle with Gun N' Roses.
