The second charge was eventually changed to discharging a firearm into an occupied structure.

“The other thing I would say is that we are really looking forward to prosecuting this matter in court on behalf of our client,” Rasmussen added, “and we believe that when all the evidence is presented in court it will be clear that the manner in which he was accused is not necessarily consistent with what Seems like it already happened."
